Defendants should take caution when entering into trial stipulations, particularly where the stipulation might be used against them in a later trial.  The 4th Circuit’s recent decision in U.S. v. Robertson emphasized the need for defendants to expressly limit stipulations to a single trial or risk having those stipulations enforced in later trials.
