4:00 P.M. – 5:00 P.M. | Redefining Expectations: Combating the Plaintiff’s Quest to Establish the FMCSR as the Standard of Care
Now more than ever, the plaintiff’s bar is focused on obtaining soundbites and admissions from motor carriers establishing the FMCSRs as the standard of care for use not only in the instant case but also in future cases. What does this mean for defending cases? How do you best present and prepare drivers and motor carrier representatives for deposition? This discussion will include insights from USLAW NETWORK’s jury consulting and courtroom technology services corporate partner, IMS Consulting & Expert Services, and focus not only on the plaintiff bar’s tactics but also on how to be prepared and address them in cases.

Session Facilitators:
Anne M. Fishbeck, Amundsen Davis LLC (Chicago, IL)

One21 recreates the warmth and authenticity of Johnny and June Cash’s home and features many never-before-seen photos and artifacts that provide a glimpse into the day-to-day life of the superstar. Rustic decor created from rough-hewn timbers, a floor-to-ceiling stone fireplace, intricate stained glass windows and antiques provide the welcoming atmosphere that was customary at Johnny and June’s own table.

8:00 A.M. – 8:45 A.M. | Nowhere to Hide! Pursuing and Responding to Innovative Investigative Techniques
Methods of investigation are ever-changing. This applies not only to how we probe a claimant’s activities and background but also to how the claimant builds her case against our drivers and companies. This session will focus on both issues. What new techniques and technologies are being used to track and investigate claimants? Conversely, what creative requests are being made of the driver and company? When are they being made? Who owns the information? What are we doing to respond? We will delve into these issues and provide tips to help you stay up to date with your investigations while also protecting your interests in response to investigations into your business.

Session Facilitators:
Nicholas A. Rauch, Larson ● King, LLP (St. Paul, MN)
David L. Stout, Jr., Jones, Skelton & Hochuli, P.L.C. (Phoenix, AZ)

9:00 A.M. – 10:00 A.M. | Three Sides of Trucking Technology
In theory, new trucking technology, which could reduce the frequency of accidents or mitigate their severity, is a good thing. However, there remains a question of whether the new technology may have some unintended consequences for driver behavior and litigation. In our hyper-criticized industry, the question of when to adopt new truck technology, and whether the technology will shift the standard of care are critical and undecided issues. In addition, what impact will the decision to equip or delay equipping fleets have on underwriting? The discussion will include USLAW NETWORK’s technical forensic engineering and legal visualization services corporate partner, S-E-A.

Session Facilitators:

Patrick E. Foppe, Lashly & Baer, P.C. (St. Louis, MO)
