The intersection of marijuana use and drug testing presents complex challenges and considerations for employers in the realm of workers’ compensation claims as it involves ever-changing state laws regarding medical and recreational marijana, as well as federal guidelines and the implications for workplace policies and procedures. This interactive discussion will explore how tis may affect workplace safety, contribute to accidents and injuries, and influence the outcome of workers’ compensation claims.

Settlement negotiations often have complexities that should be considered early in the claoim process. We will share best practices and examples of strategies to close medicals, how to plan for Medicare Set Asides, and strategies to bring the claimant back to baseline when there’s an aggravation of a pre-existing condition. In addition, USLAW corporate partner Marshall Investigative Services will discuss trends in surveillance, social media and other tools that can be implemented to assist in negotiating settlements.
